Terms of Service

1. Acceptance of Terms

By accessing or using DropaSound ("the Service") you agree to be bound by these Terms of Service and all applicable laws and regulations. DropaSound is a product of Vibe Works Studio LLC ("the Company", "we", "us", "our"). If you do not agree with any of these terms you are prohibited from using the Service.

We reserve the right to update these terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance of the new terms.

2. Eligibility and Age Requirements

By creating an account you represent and warrant that:

• You are at least 13 years old (16 in the EU)
• You have the legal capacity to enter into a binding agreement
• Your use of the Service does not violate any applicable law or regulation
• If you are between 13 and 18, your parent or legal guardian has reviewed and agreed to these Terms on your behalf

If we discover that a user is under the minimum age we will immediately suspend the account and delete all associated personal data in compliance with applicable law. To report an underage account please use our contact page.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorised use of your account
• Not create multiple accounts to circumvent bans or restrictions

4. User Content

You retain full ownership of all audio recordings and content you upload to DropaSound ("User Content"). By uploading User Content you grant DropaSound a worldwide, non-exclusive, royalty-free licence to host, store, display, and distribute your content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to upload your content
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable law or regulation

You may delete your content at any time from your profile page. Upon account deletion all your audio files will be permanently removed within 30 days.

5. Prohibited Conduct

You agree not to upload, post, or transmit any content that:

• Infringes any copyright, trademark, or other intellectual property right
• Contains hate speech, harassment, or content that promotes discrimination
• Contains nudity, sexually explicit material, or adult content
• Promotes or facilitates illegal activities
• Contains malware, viruses, or harmful code
• Impersonates any person or entity
• Violates the privacy of any third party
• Is designed to exploit, harm, or target minors

You also agree not to attempt to reverse-engineer, scrape, or otherwise misuse the Service or its infrastructure.

6. Subscriptions and Billing

DropaSound offers a free tier and a paid Pro subscription at $7.00 USD per month.

• Pro subscriptions are billed monthly in advance
• You may cancel at any time from your billing page
• Upon cancellation you retain Pro access until the end of the current billing period
• We do not offer refunds for partial billing periods
• All payments are processed securely by Stripe and subject to Stripe's terms of service
• We reserve the right to change subscription pricing with 30 days notice to existing subscribers

Free accounts are subject to monthly usage limits as described on the billing page. We reserve the right to modify free tier limits at any time.

7. Intellectual Property

The DropaSound name, logo, website design, and all software are owned by DropaSound and protected by copyright and trademark law. You may not copy, modify, or distribute any part of the Service without our express written permission. User Content remains the intellectual property of the respective users as described in Section 4.

8. Termination

We reserve the right to suspend or terminate any account at our sole discretion if we determine that you have violated these Terms, applicable law, or if we believe your account poses a risk to other users or the Service.

You may delete your account at any time from your profile settings page. Upon deletion all personal data will be removed in accordance with our Privacy Policy. Active Pro subscriptions will be cancelled automatically.

9. Disclaimers and Limitation of Liability

DropaSound is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, DropaSound shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of data, loss of revenue, or service interruption.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United States. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11. Copyright and DMCA

DropaSound respects intellectual property rights and expects users to do the same. You must not upload any audio content that infringes the copyright of any third party including but not limited to samples, recordings, melodies, or lyrics owned by others.

If you believe your copyrighted work has been uploaded to DropaSound without your authorisation please review our DMCA Policy for instructions on submitting a takedown notice.

Users who repeatedly infringe the intellectual property rights of others will have their accounts permanently terminated in accordance with our repeat infringer policy.

12. User Recordings

DropaSound is a voice recording and sharing platform. When you record and upload a drop you are sharing your original voice recording with the DropaSound community.

• You retain full ownership of your voice recordings
• Your recordings are stored as-is — DropaSound does not modify, process, or alter your audio in any way
• You are responsible for ensuring your recordings do not contain copyrighted material owned by third parties
• Pro subscribers receive longer recording times, HD quality, access to all 16 genres, and the ability to upload audio files

By uploading a recording you grant DropaSound a licence to host, store, and make your recording available to other users of the platform in accordance with your privacy settings.

13. California Residents — CCPA

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you specific rights regarding your personal information. Please see the CCPA section of our Privacy Policy for full details of your rights and how to exercise them.

DropaSound does not sell your personal information to third parties. California residents have the right to request disclosure of the personal information we have collected and to request deletion of that information.

14. Accessibility
